Congressman Lungren Says "Democrats Play Politics With Small Business"
Washington, DC – In a surprise show of political gamesmanship, the Democrat Majority brought Congressman Dan Lungren's (R-Gold River-CA) 1099 tax bill - The Small Business Paperwork Mandate Elimination Act (H.R.5141) - to the floor for consideration. Unfortunately, they attached it to another bill – The Small Business Tax Relief Act (H.R.5982) - which contains job killing provisions and would increase taxes by $19.4 billion dollars over 10 years. Lungren did not vote in favor of H.R. 5982. Lungren released the following statement....
“It is unfortunate the Democrat Majority used my bill – which I have worked on for four months – to try to pass another tax increase. I’ve been working to repeal Section 9006 of the health care bill which will increase the IRS paperwork reporting mandate for small businesses. This misguided provision will certainly increase costs on all small businesses and in these hard economic times, we just can’t afford to do that.
“Every piece of legislation which comes before the Congress should be judged on the basis of how it affects the prospect of a sustained economic recovery. The growth of our economy very much depends upon export growth. At a time when personal debt remains high domestic consumption alone is not likely to be a sufficient impetus for growth.
“Furthermore, it is simply not possible for the government to spend our way out of the current economic malaise at a time when our nation is sinking in a sea of red ink. As the Obama Administration itself has acknowledged it is essential for us to expand the growth in U.S. exports. The President recently called for a doubling of exports by 2015.
“Unfortunately, H.R. 5982 is entirely inconsistent with the need to expand exports. When you tax something you are going to get less of it. Placing additional tax burdens on American companies will make them less rather than more competitive. Penalizing American companies that compete in the international marketplace is simply wrong headed.
“I have always supported small business. So, to my great disappointment, I voted against the larger bill, which included my repeal of Sect. 9006. I’m saddened by the games that brought us to this point, but the good news is that my bill gained 158 new co-sponsors and 239 Democrats voted in support of my repeal of Sect. 9006.
“Clearly bipartisan support for this repeal is gaining momentum and we will pass this legislation. No matter how many times the House Leadership will use my legislation as a pawn in the games they are playing with American workers and families, I will stand ready to defend you will not rest until we are successful in this fight.”

None other than big corporations. And the new law he's trying to cut out is nothing but a disclosure law. You see, big financial firms havie been getting away with not paying taxes. Tsk. tsk.
That's why the Health Care legislation included this new law. Because no one should be above disclosing income that is taxable. Not even big financial firms who call Lungren their friend.
These are the firms who will be accountable: Brokerage houses. Speculative investment exchanges. Financial portfolio managers. Precious metal traders. All will have to disclose financial transactions to ensure tax obligations are being met.

The primary legislative intent behind Section 9006 is to utilize 1099 filings in order to increase information of corporate transactions. The Section does not impose any additional tax upon the corporate transaction, but rather requires all subject transactions exceeding the $600 limit be accounted. The impetus for the filing requirement being a stop-gap measure to fill the substantial loophole (hence the title of the Act) through which significant transactions go unreported and untaxed. Section 9006 does not lower the reporting amount ($600) but expands the subject class (Corporations) and activities (financial transactions). Current 1099 filing requirements for contract services remain essentially unchanged however investment transactions will fall within the proposed amendments. Brokerage houses. Speculative investment exchanges. Financial portfolio managers. Precious metal traders. All will have to disclose financial transactions to ensure tax obligations are being met. Burdens upon small business indeed.

Hoo Boy. There's a lot to unpack there but frankly it's not worth the effort. Dan Lundgren, serious statesman not he.
A slight observation, perhaps even a critique. The PineTree.Net is a laudable little blog and I say that with all sincerity. The Hamilton's are to be commended for their valuble contributions to the Calaveras community. Truly. However it's posts like these which, to this daily visitor, instills the greatest frustration. The issue lies not with the identity of the poster nor the substance of the post, cartoonish as it may be, but rather this habitual practice of inserting raw unedited press releases into the daily mix of local news and events. All under the banner of "The Celebrated News of Calaveras County and Beyond". Emphasis on "News". My quibble isn't with the posting of Congressman Lundgren's press release for he is an elected official for whom the Pinetree provides an effective constituent forum. Certainly nothing wrong with that. It's the presentation that gives pause for issue. The content of the post is purely persuasive in nature chalk full of interesting assertions and facts. Interesting as defined in cynical half-truths and fantasy but I digress. Whatever it is, news it ain't. Perhaps an inclusion of a title disclosure indicating the following is a statement released by the Congressman's press secretary equivocal to a letter to the editor might clarify the post source and content. A small enhancement which, I believe, would do much to improve the Pinetree's editorial quality and reading experience.

Good Points and the title has been changed to reflect that the release is from Congressman Lungren's Office.
Whether we agree with those whom we have elected to represent us or not we usually post their press releases. We do this for the Governor's office, President's Weekly Addresses, Congressman Lungren's office as well as communications from the late State Senator Dave Cox's Office.
We feel that if they are duly elected they have earned a small measure of "Bully Pulpit"

Lungren voted against his own legislation!
Today his bill was attached to another bill that would increase taxes on American corporations with global operations. Wanting to paint those who oppose this bill as shills for corporate interests, Lungren tried to tell us today that the House Leadership pitted the interests of small business owners and employees against the interests of employees who work for globally-successful American businesses.
What the heck is a globally-successful American business? Is it one of those businesses sitting on oodles of cash and paying their CEO's big bucks? Hell yes, let's make sure they pay their taxes.
GM is paying their taxes, and they rebounded and they are globally successful. 25% of their sales came from China recently. They worked with their labor unions and now GM is back in the black.

Corporations had lobbied a loophole in the tax laws, graciously provided by the GOP reps like Lungren who get their money from big corporations.
The bill Lungren "led the fight" against was to try and get them to account for and pay appropriate taxes. You know, sort of like the rest of us working stiffs do.
You'd think this guy would understand that unemployed and underemployed people want work, and want corporations to pay a fair share.
He's been in office way too long, and has lost touch. Even his best Public Relations people can't make this smell good.
